These Terms of Service (the "Terms") govern your access to and use of https://asmatk.com (the "Site"), which is operated by Asmatk ("Asmatk", "we", "us" or "our"). The Site publishes articles, guides and free tools about search engine optimization (SEO) and digital marketing, and describes the services we offer.

Please read these Terms carefully. They set out what you can expect from us, what we expect from you, and the limits of our responsibility. They apply to every visitor, whether you are reading an article, using one of our free tools, subscribing to the newsletter or sending us an enquiry.

Acceptance of these Terms

By accessing or using the Site, you confirm that you have read, understood and agree to be bound by these Terms, together with our Privacy Policy, Cookie Policy and Disclaimer, which are incorporated into these Terms by reference. If you are using the Site on behalf of a company or other organization, you confirm that you have authority to accept these Terms on its behalf, and "you" includes that organization.

If you do not agree with any part of these Terms, you must stop using the Site.

Eligibility

The Site is intended for business owners, marketers, website managers and other professionals. You must be at least 16 years old to use the Site, and at least 18 years old (or the age of legal majority where you live) to request a proposal or enter into a service engagement with us. By using the Site, you confirm that you meet these requirements.

Use of the Site

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable permission to access and use the Site for your own personal or internal business purposes. This permission allows you to:

• read and browse articles, guides and service pages;
• use the free tools on our SEO tools page to generate estimates for your own projects;
• print or save a reasonable number of pages for your own reference;
• share links to our pages on social media, in newsletters or on your own website;
• quote short extracts from our articles with clear attribution and a link to the original page.

The Site is a static website. It has no user accounts, no payment functions and no public comment sections, so you do not need to register to use it. We may change, suspend or discontinue any part of the Site at any time without notice, and we are not obliged to keep any particular content or tool available.

Intellectual property

Unless stated otherwise, all content on the Site, including text, articles, checklists, page layouts, graphics, icons, code, tool logic and the selection and arrangement of that content, is owned by or licensed to Asmatk and is protected by copyright, trademark and other intellectual property laws.

Except as expressly permitted in these Terms, you may not copy, reproduce, republish, translate, modify, create derivative works from, distribute, sell, license or otherwise exploit any content from the Site without our prior written permission. The name "Asmatk" and any associated logos are our marks, and you may not use them in a way that suggests endorsement or affiliation without our consent.

Third-party names and trademarks mentioned on the Site, such as the names of search engines and software products, belong to their respective owners. Their mention does not imply any affiliation with or endorsement by those owners.

If you believe that content on the Site infringes your intellectual property rights, please email [email protected] with details of the work concerned, the page where it appears and your contact information. We will review and respond to all good-faith notices.

Content accuracy

We work hard to keep our articles and guides accurate and up to date, and we reference official documentation where possible. However, search engines change their systems, guidelines and interfaces frequently, and best practices evolve. Content that was correct when published may become outdated.

All content on the Site is provided for general information only. It is not tailored to your circumstances and should not be relied upon as professional, legal, financial or technical advice. Before making decisions that affect your business, you should verify information against current official sources and, where appropriate, seek advice specific to your situation. Service engagements

The service pages on the Site describe the types of work we do, such as technical SEO audits, on-page optimization, local SEO, link building and digital PR, and social media and paid search support. These descriptions are general and are not offers capable of acceptance.

If you contact us about a project, we may send you a written proposal, statement of work or agreement. Any paid engagement is governed exclusively by that separate written document, which will set out the scope, deliverables, timelines, fees, payment terms, responsibilities and any additional terms. Where that document conflicts with these Terms, the separate written document prevails for the engagement it covers.

Sending an enquiry through the contact form, receiving a reply or receiving a proposal does not create a contract between you and Asmatk. A contract is only formed when both parties have agreed to a written proposal or agreement in the manner it specifies.

No guarantee of rankings or results

Search engines such as Google independently decide how to crawl, index and rank web pages, and they regularly update their ranking systems. Neither Asmatk nor anyone else can control those systems. For that reason:

• we do not guarantee any specific ranking position, traffic level, number of leads, revenue or return on investment;
• we do not guarantee that any page will be indexed or will appear for any particular search query;
• we do not guarantee that results achieved for one website can be repeated for another;
• we do not guarantee that rankings, once achieved, will be maintained.

Google's own guidance warns site owners to be wary of anyone who guarantees a number one ranking. We agree, and we will never make that promise.

Your responsibilities

Whether you are simply using the Site or discussing a project with us, you agree to:

• provide accurate, current and complete information when you contact us or subscribe to our newsletter;
• only submit information you have the right to share, including information about websites you own or are authorized to manage;
• keep any credentials you give us for a project secure and tell us promptly if they change or are compromised;
• review recommendations before implementing them and keep backups of your website and data;
• ensure your own website complies with the laws that apply to it, including privacy, consumer protection and advertising rules;
• comply with the terms and policies of any third-party platforms you use, such as search engines, social networks and advertising platforms.

For paid engagements, more detailed client responsibilities will be set out in the relevant proposal or agreement.

Third-party links and services

The Site contains links to third-party websites, including official documentation from search engines and links to our social media profiles. These links are provided for convenience and information only. We do not control those websites and are not responsible for their content, availability, accuracy, privacy practices or terms. Following a link means you leave our Site, and your use of the third-party website is governed by its own terms and policies.

Including a link does not mean we endorse the linked website, its owner or its products or services.

Prohibited use

You agree not to use the Site, or attempt to use it, in any way that is unlawful, harmful or disruptive. In particular, you must not:

• use the Site in breach of any applicable law or regulation;
• submit false, misleading or impersonating information through the contact form or newsletter signup;
• send spam, unsolicited advertising or bulk messages through our forms;
• upload or transmit viruses, malware or any other harmful code;
• attempt to gain unauthorized access to the Site, its servers or any connected systems;
• carry out denial-of-service attacks or otherwise interfere with the Site's operation or security;
• use automated means such as bots, scrapers or crawlers to copy, harvest or republish substantial parts of the Site, other than standard search engine crawlers that respect our robots.txt file;
• use content from the Site to train, fine-tune or build datasets for machine learning systems without our written permission;
• frame or mirror the Site on another website;
• remove or alter any copyright, trademark or other notices on the Site;
• use the Site to harass, abuse or harm any person.

We may take any action we consider appropriate in response to prohibited use, including blocking access and reporting the matter to the relevant authorities.

Disclaimers

The Site and all content, tools and information on it are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no representations or warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement or uninterrupted availability.

We do not warrant that the Site will be free of errors, viruses or other harmful components, that defects will be corrected, or that the results produced by our free tools will be accurate. The tools provide estimates only and are intended as a starting point for your own analysis.

Limitation of liability

To the fullest extent permitted by law, Asmatk will not be liable to you for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, business, goodwill, data or rankings, arising out of or in connection with your use of, or inability to use, the Site or any content or tool on it, even if we have been advised of the possibility of such loss.

Because the Site is provided free of charge, our total liability to you for any claim arising out of or relating to the Site or these Terms is limited to the greatest extent permitted by law. Liability for paid services is governed by the separate written proposal or agreement for those services.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, such as liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence. If you are a consumer, you may have statutory rights that these Terms do not affect.

Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Asmatk and its team members from and against any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of or connected with your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of any third party.

Suspension and termination

We may suspend or terminate your access to all or part of the Site at any time, without notice, if we reasonably believe you have breached these Terms or if we need to do so for security, legal or operational reasons. You may stop using the Site at any time. If you subscribed to our newsletter, you can unsubscribe using the link in any email.

Sections of these Terms that by their nature should survive termination, including those on intellectual property, disclaimers, limitation of liability, indemnity and governing law, will continue to apply.

Governing law and disputes

These Terms, and any dispute or claim arising out of or in connection with them or the Site, are governed by the laws of the jurisdiction in which Asmatk is established. The courts of that jurisdiction have jurisdiction to settle any such dispute, except where mandatory consumer protection laws give you the right to bring proceedings in the courts where you live.

Before starting any formal proceedings, we ask that you contact us at [email protected] so that we can try to resolve the matter informally. Most concerns can be settled quickly this way.

Severability and general terms

If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. You may not assign or transfer your rights under these Terms without our consent. We may assign our rights to a successor in connection with a reorganization or transfer of our business. These Terms, together with the policies they reference, form the entire agreement between you and Asmatk regarding your use of the Site, and supersede any prior understandings on that subject. They do not replace any separate written agreement for paid services.

Changes to these Terms

We may revise these Terms from time to time, for example to reflect changes to the Site, our services or applicable law. When we do, we will update the "Last updated" date at the top of this page. Changes take effect when they are posted. Your continued use of the Site after changes are posted means you accept the revised Terms, so please check this page periodically.
